1. Definitions
In these terms and conditions, the following definitions apply:
"We," "Us," "Our" refers to Baan Sabai, operating senior companion living services at 154 Moo 3, San Kamphaeng, Chiang Mai 50130, Thailand.
"You," "Your" refers to families, legal representatives, or authorized contacts who engage our services or visit our website.
"Resident" refers to the older adult receiving companion living services through our residential or day programs.
"Services" refers to residential companion living, day companionship programs, extended family retreat stays, and related support services provided by Baan Sabai.
"Agreement" refers to the service arrangement established between Baan Sabai and families, including these terms and conditions and any additional written agreements.
2. Acceptance of Terms
By engaging our services, visiting our facilities, or using our website, you agree to be bound by these terms and conditions. If you do not agree with these terms, please do not proceed with service enrollment or website usage.
These terms constitute a legally binding agreement between you and Baan Sabai. We reserve the right to modify these terms at any time, with notice provided to active service recipients. Continued use of services after modifications constitutes acceptance of updated terms.
3. Eligibility and Capacity
To engage our services, you must be at least 18 years of age and legally authorized to make decisions on behalf of the resident. If you are acting as a legal representative or guardian, appropriate documentation of authority may be requested.
You warrant that all information provided during enrollment, including health considerations, emergency contacts, and financial details, is accurate and complete. You agree to promptly notify us of any changes to this information.
4. Service Description
Baan Sabai provides senior companion living services in Chiang Mai, Thailand, including:
Residential Companion Living
Full-time living arrangements in shared household settings with private rooms, shared meals, daily activities, and attentive staff support. Monthly arrangements with flexible terms.
Day Companionship Program
Daytime programs operating five days per week, including supervised activities, social interaction, meals, and optional transportation assistance. Participants return home each evening.
Extended Family Retreat Stay
Temporary residential arrangements for one to six months, providing supportive environments during transitional periods with personalized routines and regular family communication.
We do not provide medical services, nursing care, or specialized healthcare interventions. Our focus is companion care and daily life support for older adults who do not require intensive medical supervision.
5. Service Limitations
While we strive to provide attentive companion care, families should understand the following limitations:
Our staff are trained in companion care approaches but are not medical professionals. We cannot provide nursing care, administer medications beyond basic reminders, or handle acute medical situations. Residents requiring ongoing medical supervision should consult with appropriate healthcare providers.
We maintain partnerships with local healthcare providers and will coordinate with them when necessary, with family authorization. However, responsibility for medical decisions and healthcare arrangements remains with families and designated healthcare providers.
Activities and programs are offered based on availability and may be adjusted according to circumstances, staff availability, or resident preferences. We cannot guarantee participation in specific activities or particular outcomes from program participation.
6. Payment Terms
Service fees are charged monthly in Thai Baht (฿) according to the selected living arrangement:
Residential Companion Living: ฿15,000 per month
Day Companionship Program: ฿4,800 per month
Extended Family Retreat Stay: ฿65,000 per month
Payment is due at the beginning of each month, with invoices provided at least five business days in advance. Accepted payment methods include bank transfer, cash, and credit card payments (processing fees may apply).
Late payments incur a ฿500 administrative fee after ten days past the due date. Continued non-payment may result in service suspension after written notice and reasonable opportunity to resolve outstanding balances.
Fees are subject to adjustment with 30 days written notice to families. Current pricing reflects services as described and may change to account for operational costs, expanded services, or economic factors.
7. Refund Policy
For residential and extended stay arrangements, refunds are calculated on a pro-rated basis for unused portions of the month if service is discontinued mid-month due to circumstances beyond resident control, such as hospitalization or relocation to higher-level care facilities.
For day program services, refunds may be provided for unused scheduled days within the current month, calculated at a daily rate. Advance notice of at least three business days is required for refund consideration.
Voluntary withdrawal from services with less than 14 days notice does not qualify for refunds of the current month's fees. This policy reflects staffing and resource commitments made based on enrollment.
8. Family Responsibilities
Families enrolling residents in our services agree to the following responsibilities:
Provide accurate and complete information about the resident's health status, preferences, routines, and any considerations affecting daily care. Update this information promptly when changes occur.
Maintain regular communication with Baan Sabai staff regarding the resident's wellbeing, participate in scheduled reviews or discussions about care arrangements, and respond to staff communications within reasonable timeframes.
Ensure that appropriate healthcare providers are engaged for medical needs, authorize us to coordinate with healthcare providers when necessary, and make timely decisions regarding medical care when situations arise.
Provide necessary personal items, clothing, and any special supplies required by the resident. While we maintain comfortable living environments, families are responsible for personal belongings.
Respect the rights and comfort of other residents by maintaining appropriate conduct during visits and avoiding disruptions to household routines or other residents' experiences.
9. Termination of Services
Either party may terminate the service arrangement under the following conditions:
By Families
Families may discontinue services at any time with 14 days written notice. This notice period allows us to adjust staffing and operations accordingly. Fees for the notice period are due regardless of whether the resident remains in residence during this time.
By Baan Sabai
We reserve the right to discontinue services with 30 days written notice if the resident's needs exceed our capabilities, if payment obligations are not met despite reasonable efforts to resolve outstanding balances, or if family conduct creates unsafe or disruptive conditions for other residents or staff.
In cases of immediate safety concerns, emergency health situations requiring higher levels of care, or severe behavioral issues affecting other residents, services may be terminated with shorter notice. We will work with families to facilitate appropriate transitions in such circumstances.
10. Limitation of Liability
While we maintain appropriate safety measures and exercise reasonable care, Baan Sabai cannot be held liable for:
Health changes or medical conditions arising from natural aging processes or pre-existing conditions, except where such changes result from our negligence or failure to provide agreed-upon services.
Personal property loss or damage, unless resulting from staff negligence. Families are encouraged to avoid bringing valuable items to the facilities. We maintain reasonable security but cannot guarantee against all forms of loss.
Actions or behaviors of other residents that may affect your family member's experience, though we maintain conduct standards and intervene when necessary to ensure safe, comfortable environments for all residents.
Force majeure events including natural disasters, government actions, public health emergencies, or other circumstances beyond our reasonable control that affect service delivery.
11. Intellectual Property
All content on our website, including text, images, logos, and design elements, is owned by Baan Sabai or used with appropriate permissions. You may view and use website content for personal, non-commercial purposes related to evaluating or using our services.
Reproduction, distribution, modification, or commercial use of website content without written permission is prohibited. This includes copying content for use on other websites, in marketing materials, or in publications.
12. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of Thailand. Any disputes arising from these terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.
We encourage families to address concerns or disputes through direct communication with our management before pursuing legal remedies. Most issues can be resolved through constructive dialogue and mutual understanding.
13. Privacy and Data Protection
Personal information collected during service provision is handled according to our Privacy Policy, which complies with Thailand's Personal Data Protection Act (PDPA). Please review our Privacy Policy for detailed information about data collection, usage, and protection practices.
14. General Provisions
Entire Agreement
These terms, together with any written service agreements and our Privacy Policy, constitute the entire agreement between Baan Sabai and families regarding services. Verbal statements or representations not included in written agreements are not binding.
Severability
If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver
Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision. Waivers must be in writing to be effective.
Assignment
These terms and the service relationship they create are personal in nature and may not be assigned or transferred to other parties without written consent from Baan Sabai.
15. Changes to Terms
We may update these terms and conditions periodically to reflect changes in our services, legal requirements, or operational practices. When significant changes occur, we will notify active service recipients through direct communication.
Changes become effective 30 days after notification unless otherwise specified. Continued use of services after the effective date constitutes acceptance of modified terms. If you do not agree with changes, you may discontinue services according to the termination provisions outlined above.
